Texas man charged with murder after shooting intruder before going back to bed

DALLAS — A Dallas resident who fatally shot a backyard intruder and then went back to bed has been charged with murder, according to police.

The homeowner, James Michael Meyer, said he didn’t know whether he struck the person, so he went back to bed and didn’t call police, according to an arrest warrant released by the Dallas Police Department.

Meyer, 72, says that he was awakened around 5 a.m. Thursday by a noise outside, according to an arrest warrant affidavit filed by Dallas police. Meyer told police he looked outside and saw someone attempting to break into his storage shed, and that’s when he got his handgun and went outside to confront the person.

Meyer told the intruder not to come any closer or he would shoot him, the warrant reads. Meyer said the man took a few steps toward him with a pickax in his hand, the warrant says, and that’s when he fired his gun. He said the unidentified man dropped the pickax and ran into the park behind his property. Meyer told police he fired another shot “into the night” in the direction of the park and then went to bed.

As the sun began to rise, Meyer looked outside and saw what he thought was a black bag in the park. He went to get a closer look, according to the warrant, and discovered a man lying facedown on the ground.

Meyer said he had his wife contact an attorney before he called 911 at 7:04 a.m. to report a home invasion in progress.

Meyer refused to answer the 911 dispatcher’s questions and repeatedly said “he was a victim of a crime and that medical assistance was needed,” according to the warrant.

Police officers arrived to find the deceased male lying facedown in the park behind Meyer’s home with a gunshot wound to the back of his neck, Dallas police said in a post on the department website. The warrant said Dallas Fire Rescue determined the person had been dead for several hours.

Crime scene analysts called to process the scene couldn’t find any spent shell casings. According to the warrant, Meyer told them that he picked them up and threw them away. Detectives also noted in the warrant that several neighbors stated hearing three gunshots, not two.

Meyer was arrested and charged with murder Thursday. He was released from jail Friday after posting the $150,000 bond, according to records from the Dallas County Sheriff’s Office.

Dallas Police have not identified the man who was shot.

A Florida woman is facing attempted murder charges after police say she told her four children to unbuckle their seat belts and then purposefully drove a minivan into a tree yesterday.

Calicia Williams and the children, who are between 7 and 13 years old, were all injured in the crash, Ocala police said in a release.

Williams was speeding and told the children to take off their seat belts and stretch out their hands before the crash, according to the release.

"The devil can't hurt you, he only hurts bad people," Williams said just before the crash, according to the police report, which cited a witness whose name was redacted. "You have the light of Jesus in you and only Jesus can cure us," according to the police report.

Williams was standing outside of the van when police arrived. She told an officer that her husband had put a hex on her and caused her to crash, and she "kept rambling on about spells and voodoo," according to the police report.

Williams also told police that she had "marijuana in her system," the report said.

"(D)ue to tire and furrow marks in the median it appeared the Pontiac was steering directly toward the tree that was struck," the investigator at the site reported, according to the release.

Williams and the four children were transported to local hospitals. The children are in stable condition, a police spokesperson told CNN.

The children's injuries were not life-threatening, WKMG reported, citing Ocala police spokeswoman Corie Byrd.

Williams was arrested and charged with four counts of attempted murder. She will be taken into custody when she is released from the hospital.

CNN wasn't able to determine if Williams has an attorney.

FORT DODGE, Iowa The suspect in a Pennsylvania pastor's murder was in court via video conference Friday, KCCI reports.

Joshua Pendleton, 36, is being held on a $6 million bond.

He will stay in the Webster County jail in lieu of the cash-only bond.

He is charged with the robbery and murder of 64-year-old Allen Henderson.

Henderson's body was found Wednesday outside Saint Paul Lutheran Church.

“It was apparent that Mr. Henderson was involved in a physical assault and sustained injuries consistent with being in an assault,” said Capt. Ryan Gruenbergwith Fort Dodge police.

In an interview with authorities, Pendleton said he was at the church and got in a fight with Henderson, according to court records.

Police say Pendleton had Henderson's cell phone, gave it to them and said he had taken it.

Henderson, who was a police chaplain, was friends with multiple police officers and firefighters.

Gruenberg says the death is harder to deal with because of the close connection Henderson had with authorities.

“We're getting through it,” Gruenberg said. “We're pushing forward. We are offering each other support. We will find a way through it. It won’t be easy, but we will find a way.”

Funeral services are scheduled for Saturday.

CHARLOTTE, N.C. — An out-of-town doctor and CEO was shot in uptown Charlotte Monday and died of his injuries Saturday, WCNC reports.

Dr. John Holaday, 74, was pronounced dead at Atrium Health’s Carolinas Medical Center and Raheem Shacklette, 16, has been charged with murder in connection to the shooting, Charlotte-Mecklenburg police say.

An argument at the Epicentre that Holaday was reportedly not involved in is what led to the shooting.

Officers say that they found Holaday in the street suffering from an apparent gunshot wound.

His company, DisposeRx,  says that Chairman, Founder and CEO John Holaday, Ph.D., was walking to an uptown Charlotte business meeting before he was randomly shot.

DisposeRx released the following statement:

“The DisposeRx family is in shock that a random unrelated altercation could result in profound injuries to our chief executive officer,” said William Simpson, DisposeRx President. “But we know John. He is strong and healthy, and he is a fighter. We will stand by John, his wife and sons as he recovers, and we remain committed to fulfilling his vision and mission at DisposeRx. VIRGINIA BEACH, Va. — A man pleaded guilty to killing his wife’s lover, WTKR reports.

New court documents give information about what unfolded the night of the shooting.

Dispatch received a call at 3:05 a.m. on March 2 for service in the 2400 block of Hunting Horn Way.

When police arrived, they found a man who was suffering gunshot wounds. He was pronounced dead at the scene.

The victim was later identified as 37-year-old Vinicius Freire Carneiro of Virginia Beach.

During the investigation, Naumovic was detained for further questioning and was later arrested.

Warrants were obtained for second-degree murder and use of a firearm in commission of a felony, but Wednesday he pleaded guilty to voluntary manslaughter.

Carneiro was visiting a woman he knew at her home on Hunting Horn Way for a sexual encounter.

Naumovic fired 11 rounds while he stood two and a half feet from the victim, who was naked and wrapped in a comforter.

The wife called 911 and performed CPR, but it was too late.

GRAND RAPIDS, Mich. - Jared Chance will likely spend the rest of his life in prison, after murdering and dismembering Ashley Young in 2018.

He learned his sentence Thursday after first hearing victim impact statements from members of Young's family.

"Jared Chance I hate you," said Kristine Young, Ashley's mother, during her statement. “You had no right to take her from me - to take her from her family.”

Parts of Young's body still haven't been found. Finding her is a fight her family says they intend to keep up, according to WXMI.

"I believe you are evil," Judge Trusock said before handing down the sentence of 100 to 200 years in prison. That's far above the state guidelines for second-degree murder. “You are clearly a monster without any conscience whatsoever.”

Judge Trusock couldn't sentence Chance to life without parole because his murder conviction was on a 2nd degree charge.

The judge explained that Chance will not be eligible for parole until he is 130 years old.

Chance's parents are facing charges for allegedly helping their son cover up the killing.

The judge said the maximum possible sentence would be death.

Felton, who appeared first, came out on crutches and cried while standing before the judge. She's charged with first-degree murder and five counts of attempted first-degree murder.

Watlington followed after Felton. The suspect was stone-faced. She is charged with first-degree murder, five counts of attempted first-degree murder, driving while impaired, felony death by vehicle and felony hit and run, according to jail records.

The father of 30-year-old Zanelle S. Tucker, who died, spoke and asked the court, "Why did she kill my daughter? What was the purpose? She had two little kids too."

A fight broke out at about 3 a.m. Saturday at the Exxon at 3028 West Gate City Blvd.

“They beat my niece and daughter for hours at the store. Where was the protect and serve at?” Paula Edmondson, the mother of Felton and the aunt of Watlington, said after the court appearance

She claimed that the two had tried to break up a fight and were jumped by a group of people.

“No one came to their rescue to help them. No one called the police. Everybody egging the fight on, but no one tried to stop it,” Edmondson said.

The two women were seen on multiple cellphone videos yelling and being punched by a group of various people.

Edmondson continued to say that her two family members had tried to get away and were not behind the wheel of the SUV. She stated that there was a third person in the vehicle.

Police say the SUV hit multiple people. Tucker died at the scene while five other victims were taken to local hospitals for treatment, including one of Tucker's cousins.

Three of the victims are in critical condition with life-threatening injuries.

“Justice should be served and will be served the proper way. It’s more to the footage that they say. But they see the worst part. They don’t see the worst part before they beat her. Before they beat them,” Edmondson said.

Suspect arrested because of a lost SD memory card charged with killing another woman

A grand jury in Alaska returned an additional murder indictment Thursday against a man already charged with the murder and sexual assault of another woman.

Brian Steven Smith, 48, had already been indicted in the death of Kathleen J. Henry, 30, whose assault was captured on a memory card that contained videos and photos of Smith allegedly killing her, authorities say.

While interviewing Smith about Henry, he admitted to Anchorage police that he had shot another woman and told police where to find her body, according to court documents filed Thursday. Alaska State Troopers later recovered a skull with a gunshot wound near the location that Smith provided to police, according to the documents.

The grand jury also added additional charges of tampering with evidence and misconduct involving a corpse for the second victim, identified as Veronica Abouchuk, Alaska Deputy District Attorney Brittany L. Dunlop said.

Abouchuk, 52, was reported missing by her family in February; they had last seen her in July 2018, Anchorage Police Chief Justin Doll said at a press conference.

Smith remains in custody at the Anchorage Correctional Complex on a $750,000 cash bail, according to the Alaska Attorney General’s office, but based on the new charges, prosecutors filed the bail memorandum requesting bail be increased to $2 million.

Smith’s public defender, Daniel L. Lowery, declined to comment on the new charges, citing the ongoing case. Smith is expected to be arraigned on the new charges on October 21, Dunlop said.

The first murder charge

Smith was arraigned Wednesday on eight counts related to Henry’s death, including sexual assault, murder, and tampering with evidence after authorities said a SD memory card found on the street contained videos and pictures of him killing her, according to court records. Smith’s public defender entered a not guilty plea on his behalf.

On September 30, a woman called police in Anchorage to say she had found an SD card that contained pictures and videos of a woman being strangled, beaten and raped, according to an affidavit of the criminal complaint. The SD card was labeled “homicide at midtown Marriott,” authorities said.

The card contained 39 photos and 12 videos of a naked woman bruised and bloodied on a floor next to a bed, according to the affidavit. Videos showed the woman being strangled and struggling to breathe as a man laughed about it, the document said.

Two days after the SD card was turned in, police said they responded to a call about human remains found near the Seward Highway in the southern part of the city. The remains, they believed, were of the woman in the photos and videos.

Authorities later identified Brian Steven Smith, a South African immigrant, as a suspect and arrested him at the Ted Stevens Anchorage International Airport on October 8.

2 being charged in death of Kamille ‘Cupcake’ McKinney, missing girl found in trash

BIRMINGHAM, Ala. — Two people will be charged with kidnapping and capital murder in the death of a 3-year-old Alabama girl whose body was found in a dumpster.

Birmingham Police Chief Patrick Smith said at a news conference that Patrick Stallworth, 39, and Derick Irisha Brown, 29, will face charges.

The remains of Kamille “Cupcake” McKinney were discovered on Tuesday.

‘It only takes a split second’

Police believe the kidnapping was something Stallworth and Brown thought about and acted upon and they found an opportunity to take the young child, Smith said Tuesday.

The investigation will reveal what happened after that, he said.

“It only takes a split second,” Smith said in the news conference. “We can no longer assume that everyone is a part of the village that is trying to raise the child.”

The toddler was at a birthday party in the apartment complex her family lived in.

A multi-state Amber Alert issued after her disappearance said she may have been abducted by a man and a woman in a dark-colored SUV.

Police didn’t get any information on the child’s location when they first interviewed Stallworth and Brown — but were able to secure warrants on unrelated charges.

Stallworth, who was back in police custody Tuesday, was previously charged with four counts of possession of child pornography and three counts of possession of child pornography with intent to distribute.

Brown remains in custody for an unrelated kidnapping.

Smith said Tuesday there is no connection between the two and Kamille’s family.

“This young child has touched a nation,” the chief said. “This young child has definitely sent a message across that nation that we all must be diligent to protect them all.”

The surveillance video

On Friday, police released surveillance video they hoped would help find the child, of two men seen outside the housing complex. Kamille and another 3-year-old child are also seen in the video, recorded the night she disappeared, according to police Chief Patrick Smith.

The video shows one man first walking past the two children. Later, another man stops and appears to talk to them. The video ends just after the two children follow the second man out of view of the camera.

One man was a suspect and the other may have had information about the girl’s disappearance, police had said.

Her father pleaded for her return

Kamille, 3 feet tall and 60 pounds, was last seen wearing a pink T-shirt with a Minnie Mouse leopard print design, the Amber Alert had said.

For days, the state and country helped search as police remained hopeful to find the young girl alive.

“In my heart, I believe that she is alive, and we are going to press forward in hopes that she is. It is my hope and prayer that we are able to bring her back home to her family safely,” Smith said last week.

He asked residents of the apartment complex Kamille was taken from to come forward with any cell phone video that may be helpful.

Crime Stoppers of Metro Alabama offered a $20,000 reward to anyone with information which would help police solve the crime.

Alabama Gov. Kay Ivey offered a $5,000 reward for information leading to the arrest and conviction of anyone involved in the kidnapping. A private individual put up another $1,000.

Her father begged for the girl’s return.

“Drop her off anywhere and let her out. Somebody will see her. Everybody knows what’s going on,” Dominic McKinney told WBMA. “That will be the end of that. We just want the baby back.”

Alabama Governor Kay Ivey released a statement, saying:

“Given the tragic news that is breaking this evening, I offer my heartfelt condolences to Kamille’s family. I offer profound thanks to law enforcement and to all the volunteers who have worked tirelessly in search of this precious little girl. The heart of our state is broken, but we must do all we can to avoid this happening to another family. Our prayers remain with Kamille’s family and all who have been touched by this nightmare.”

In a deal entered Wednesday, Aaron Trejo pleaded guilty to one count of murder and one count of feticide, both felonies. Last December he confessed to fatally stabbing his classmate, who was six months pregnant, in the heart and then concealing her body in a dumpster with a black plastic bag, according to court documents.

“I took action. … I took her life” because it was too late for her to have an abortion, Trejo, 17, had said. According to court documents, Trejo said that neither he nor his victim, Breana Rouhselang, 17, wanted to have the child.

CNN was unable to reach Trejo’s family. His attorney James Korpal declined to comment.

Trejo murdered Rouhselang using a knife because he thought it would kill her quickly, court documents show. After taking Rouhselang’s life, Trejo threw the knife and her cell phone into a river. An autopsy confirms that her scarf was tied so tightly that strangulation occurred before she died from multiple stab wounds. Documents did not specify who tied the scarf.

Rouhselang’s stepmother Nicole declined to comment.

Trejo and Rouhselang both attended School City of Mishawaka. Superintendent Wayne Barker released a statement Wednesday:

“We trust our local authorities to complete the legal process which includes sentencing in January. Our thoughts are with the Mishawaka families who continue to grieve this terrible loss.”

The plea agreement establishes that any other criminal charges arising from the incident will be barred by double jeopardy.

Trejo, who was charged as an adult, faces 45-65 years in prison for murder and 3-16 years for feticide.

This is still an open investigation until judge Elizabeth Hurley accepts the plea bargain, which would occur at the sentencing hearing, Saint Joseph County Metro Homicide Unit Assistant Commander Lt. Alex Arendt told CNN.

A sentencing hearing is scheduled for January 7, 2020.
